Booking terms & cancellation policy

Clear booking conditions for a relaxed stay at Casa Lux. These terms apply to reservations made directly through our website, by email, or through another direct method operated by the owners.

Who provides the accommodation

Casa Lux is operated jointly and personally by Michelle Laurette J Van Damme and Gilles Adrien Alexandre A Cenni, together referred to as “Casa Lux”, “we”, “us” or “our”.

When these terms apply

These terms govern direct bookings only. A booking made through a booking platform or travel partner is also subject to that platform’s payment and cancellation conditions. The Casa Lux House Rules and safety requirements apply during every stay unless they conflict with mandatory law or binding platform terms.

Booking and lead guest

  • The lead guest must be at least 18 years old and legally capable of entering into the booking.
  • The lead guest must provide complete and accurate information and ensure that all guests comply with these terms and the House Rules.
  • A booking is confirmed only after the required payment has been received and Casa Lux has issued written confirmation.
  • The booking may not be transferred, resold or sublet without our prior written agreement.

Occupancy, registration and visitors

The number and composition of guests may not exceed the booking confirmation or the legally registered capacity of Casa Lux. Unless confirmed otherwise in writing, the maximum is six guests, with no more than four adults.

  • Every overnight guest must be included in the booking and complete the identification and registration requirements applicable in Spain.
  • Only registered guests may enter or use the property. Unregistered visitors are not permitted unless Casa Lux gives prior written approval.
  • Parties, events, receptions, commercial activities and gatherings are not permitted.
  • We may refuse entry or terminate the stay where guest numbers or identities materially differ from the confirmed booking.

Price and payment

The total price and any selected Casa Lux extras are shown before payment and confirmed in the booking summary.

  • A 35% payment confirms the reservation.
  • For stays beginning in July or August, the remaining balance is due 12 weeks before arrival.
  • For stays beginning in any other month, the remaining balance is due 8 weeks before arrival.
  • Bookings made within the applicable balance period are payable in full when booked.
  • A refundable security deposit of € 1.000 is due 21 days before arrival, or immediately for bookings made within 21 days of arrival.
  • Check-in details are provided after all payments then due, including the security deposit, have been received.
  • Promotional, referral or discount codes may only be applied once per reservation/checkout and cannot be combined with other promotional codes.

If a payment is not received by its due date, we may treat the booking as cancelled by the guest after sending a reasonable payment reminder.

Cancellation by the guest

Cancellation requests must be sent in writing via our Contact Form or by replying directly to your confirmed booking email. A cancellation takes effect when it is received by us.

48-hour cancellation period

A guest may cancel within 48 hours after booking for a full refund, provided the scheduled arrival date is more than 14 days away at the time of cancellation. This 48-hour period does not apply to bookings made within 14 days of arrival.

After the first 48 hours

After the 48-hour period has expired, the 35% booking payment is non-refundable.

When the full booking becomes non-refundable

  • For stays beginning in July or August, the full reservation becomes non-refundable 12 weeks before arrival.
  • For stays beginning in any other month, the full reservation becomes non-refundable 8 weeks before arrival.
  • Bookings made within the applicable non-refundable period are payable in full and are non-refundable from confirmation.
  • No refund is due for a no-show, late arrival, unused nights or early departure.

Any mandatory rights arising under applicable law remain unaffected.

Changes requested by the guest

Requests to change dates, guest numbers or booking details are subject to availability and written approval. A change is confirmed only after written confirmation has been issued and any price difference has been paid. If a requested date change cannot be accepted, the original booking and cancellation policy continue to apply.

Security deposit and damage

The € 1.000 security deposit may be used for reasonable, documented costs resulting from damage beyond normal wear and tear, missing items, exceptional cleaning, lost keys or access devices, unauthorised guests or events, misuse of the property or pool, late departure, call-out costs caused by a guest, or another material breach of these terms or the House Rules.

Any undisputed balance will be returned to the original payment method within 14 days after check-out. If substantial damage, specialist assessment or third-party repair quotations are required, we will notify the lead guest within the initial 14-day period, explain the amount temporarily retained and provide the available supporting information. The assessment will be completed within 30 days after check-out wherever reasonably possible. Only the amount reasonably required for the unresolved issue may be retained, and the remaining balance will be returned.

The security deposit does not limit the guest’s responsibility where documented loss or damage exceeds € 1.000.

Arrival and departure

  • Check-in is from 16:00 on the arrival date.
  • Check-out is no later than 10:00 on the departure date.
  • Early check-in or late check-out is possible only with prior written approval and may carry an additional charge.
  • Guests must follow the arrival, access, parking and departure instructions provided before the stay.

House Rules

Guests must use Casa Lux responsibly as private holiday accommodation and comply with the House Rules, safety instructions and reasonable instructions from the owners or property manager.

  • Smoking is prohibited throughout the property. Vaping is permitted outdoors only and must not cause damage or nuisance.
  • Pets are not permitted.
  • No unregistered visitors, parties or events are permitted.
  • Guests must avoid excessive noise or conduct that disturbs surrounding properties and comply with applicable noise and environmental rules.
  • Glassware is prohibited in and around the pool. Suitable non-glass drinkware is provided.
  • The barbecue must be supervised by a responsible adult at all times while lit or hot and must be fully extinguished after use.
  • Furniture, equipment and safety devices may not be moved, disabled or used for a purpose for which they were not intended.

A serious or repeated breach may result in termination of the stay and a requirement to leave the property. Where the stay is lawfully terminated because of a guest’s serious breach, no refund is due for unused nights.

Security cameras

Casa Lux uses limited exterior security cameras. During a guest stay, only the cameras covering the entrance gate and its immediate access area remain active, for the safety and security of guests and the property. Before check-in, all other cameras are switched off or physically redirected so that they do not capture guest-use areas. No camera is used to monitor the interior of the villa, the swimming pool, terraces or other private guest areas. Access to entrance camera images is restricted. Further information is provided in the Casa Lux Privacy & Cookies Policy and on the video-surveillance notice displayed at the entrance.

Children, pool and outdoor areas

Casa Lux has a private swimming pool, terraces, steps and outdoor areas. There is no lifeguard.

  • Children, non-swimmers and vulnerable guests must be actively supervised by a responsible adult at all times, especially around the pool.
  • Running, unsafe diving, dangerous play and glassware in the pool area are prohibited.
  • Guests are responsible for deciding whether the property and its facilities are suitable for the ages, mobility and needs of their group.

Pool heating

Pool heating is optional and must be requested and paid for in advance. The system is designed to increase the natural water temperature by approximately 5°C, subject to weather, wind, overnight temperature, pool-cover use and other environmental conditions. A specific temperature cannot be guaranteed and the pool will not be heated above 32°C.

If the heating system suffers a material technical failure that cannot reasonably be repaired during the stay, the appropriate remedy will normally be limited to a refund of the affected pool-heating charge. This does not normally entitle the guest to cancel or receive a refund for the accommodation.

External services

Private chefs, massage therapists, yoga instructors, transfer providers and similar services are independent third parties. Guests contract with and pay the provider directly. Unless mandatory law provides otherwise, Casa Lux is not responsible for an independent provider’s availability, acts, omissions, quality, cancellation terms or charges.

Maintenance, access and utilities

Guests must promptly report faults, damage or safety concerns and allow us a reasonable opportunity to investigate and resolve them. Reasonable access may be required for urgent repairs, safety checks, pool care or prevention of damage. Except in an emergency, we will provide reasonable notice and minimise disruption.

Internet, electricity, water and other utilities may occasionally be affected by weather, rural infrastructure, public networks or third-party suppliers. We will take reasonable steps to assist, but uninterrupted service cannot be guaranteed where an interruption is outside our reasonable control.

Guest responsibility

  • Guests must take reasonable care of the property, close and secure doors and gates, and follow operating and safety instructions.
  • The lead guest is responsible for reasonable, documented loss or damage caused by any member of the group or by any person admitted to the property with the group’s involvement.
  • Personal belongings, vehicles and valuables remain the guest’s responsibility. Guests should use available security measures and should not leave valuables unattended.

Our responsibility and limits of liability

Nothing in these terms excludes or restricts liability that cannot legally be excluded, including liability for fraud, deliberate misconduct, or death or personal injury caused by our negligence.

To the fullest extent permitted by law, we are not responsible for loss arising from:

  • a guest’s own act, omission, negligence or breach of these terms;
  • unsafe, unauthorised or improper use of the villa, pool, barbecue, equipment or outdoor areas;
  • failure to supervise children, non-swimmers or vulnerable guests;
  • loss, theft or damage to belongings unless caused by our proven fault;
  • weather, insects, wildlife, rural conditions, road conditions or other natural features of the location;
  • interruptions or failures caused by public utilities, telecommunications providers or other third parties;
  • indirect, consequential, business or unforeseeable losses; or
  • travel arrangements, flights, rental vehicles or other services booked independently by the guest.

Guests must take reasonable steps to limit any loss and report a problem promptly so that we have an opportunity to investigate and, where possible, correct it.

Cancellation or changes by Casa Lux

We may cancel or materially change a booking only where reasonably necessary, including where the property becomes unavailable, unsafe or legally incapable of being occupied. We will inform the guest as soon as reasonably possible.

If we cannot provide the booked accommodation, we will refund the amounts paid to Casa Lux for the affected booking. Where practical, we may also offer alternative dates. Except where mandatory law requires otherwise, we are not responsible for independent travel or third-party costs.

Travel insurance

Guests are strongly advised to obtain comprehensive travel insurance immediately after booking. Suitable cover should include cancellation, illness, accident, medical treatment, travel disruption, lost or delayed luggage, personal liability and circumstances affecting the guest’s ability to travel. The Casa Lux cancellation policy continues to apply where the guest’s circumstances are not covered by mandatory law.

Complaints and issues during the stay

Any problem should be reported as soon as reasonably possible using the guest assistance number so that we have an opportunity to investigate and provide an appropriate solution. Waiting until after departure to report an issue may affect the remedy available where the issue could reasonably have been avoided or reduced. Mandatory consumer rights remain unaffected.

Official Andalusian complaint forms are available at the property in accordance with applicable requirements.

Personal data, cookies and guest registration

Personal data is processed in accordance with the Casa Lux Privacy & Cookies Policy. Guest identity, booking and payment information may be collected, retained and communicated to Spanish authorities where required by tourism, public-security, tax or other applicable laws. The policy also explains website cookies, booking technology and the limited entrance-gate video-surveillance system.

Governing law and general provisions

These terms and direct bookings for Casa Lux are governed by Spanish law. Consumers retain any mandatory rights available under the law that applies to them, including rules governing jurisdiction.

If any provision is invalid or unenforceable, the remaining provisions continue to apply. A failure or delay in enforcing a provision does not waive it. The version accepted when the booking is confirmed applies to that booking.
